The Airport is not required to pay compensation

The Regional Court in Gdańsk dismissed two more lawsuits brought by property owners against the Gdańsk Lech Wałęsa Airport. One of them demanded over PLN 170,000 in damages, the other - PLN 100,000.

Both claimed that the value of their properties had decreased after the Restricted Use Area was established around the Gdańsk Airport. On 30 September, the Regional Court in Gdańsk ruled that the resolution of the Pomeranian Province Assembly on the establishment of this area did not affect the real estate at Wzgórze Mickiewicza and did not impose any restrictions on the use of this real estate, so that its owners did not suffer any damage. On 27 September a similar decision was made in respect of a single-family house at Jaśminowy Stok Street in Gdańsk Kokoszki. A wave of claims against Polish airports, including Gdańsk Airport, has arisen in connection with the obligation to designate so-called restricted use areas. These are areas around airports, the size and reach of which were established by the assemblies of individual provinces. For the Gdańsk airport, the area was established in March 2016 by a resolution of the Pomeranian Province Assembly. From that moment on, the property owners in the area started to claim compensation from the Airport. About 5,000 of them have been received so far.
